PlayPeak Standard Rental Agreement
This agreement governs all equipment rentals facilitated through the GoPlayPeak platform. By completing a booking, both the Owner and the Renter agree to these terms.
Equipment & rental period
The Renter agrees to rent the equipment listed in the booking confirmation ('Equipment') from the Owner for the dates specified ('Rental Period'). The rental is facilitated through the GoPlayPeak platform ('Platform') but is a direct agreement between the Owner and the Renter.
Condition & use
The Renter agrees to use the Equipment only for its intended purpose, in a safe and lawful manner, and in accordance with any instructions provided by the Owner. The Renter will not sublet, lend, or transfer the Equipment to any third party without the Owner's written consent.
Responsibility for damage or loss
The Renter accepts full responsibility for any damage, loss, or theft of the Equipment during the Rental Period. The Renter agrees to return the Equipment in the same condition as received, accounting for normal wear and tear. If the Equipment is damaged, lost, or stolen, the Renter agrees to compensate the Owner for the reasonable cost of repair or replacement, up to the Equipment's current market value.
Security deposit
Where applicable, a refundable security deposit may be collected at the time of booking or pickup, as specified by the Owner. The deposit will be returned within 5 business days of the Equipment's return, provided no damage, loss, or outstanding charges are identified. Any deductions from the deposit will be itemised and communicated to the Renter.
Pickup & return
The Renter agrees to pick up and return the Equipment at the agreed time and location. Late returns may result in additional daily rental charges at the Owner's listed rate. Failure to return Equipment without notice may be treated as theft.
Cancellations
Cancellations made at least 24 hours before the scheduled pickup time are eligible for a full refund. Cancellations made within 24 hours of pickup may be subject to the Owner's cancellation policy. No-shows are not eligible for a refund unless otherwise agreed in writing. Owners who cancel confirmed bookings may be subject to penalties under GoPlayPeak's host policies.
Liability & risk
The Renter voluntarily assumes all risks associated with the use of the Equipment, including physical injury, property damage, and death. GoPlayPeak does not provide insurance for rentals. Renters and Owners are encouraged to verify their personal or homeowner's insurance coverage before participating in a rental. To the fullest extent permitted by law, GoPlayPeak shall not be liable for any indirect, incidental, or consequential damages arising from the rental.
Disputes
In the event of a dispute between Owner and Renter, both parties agree to first attempt resolution in good faith. GoPlayPeak may assist as a neutral intermediary but is not obligated to resolve disputes or compensate either party. Unresolved disputes may be escalated through applicable legal channels in the Province of British Columbia.
Platform role
GoPlayPeak is a marketplace platform that facilitates connections between equipment owners and renters. GoPlayPeak does not own, inspect, or insure any listed equipment. GoPlayPeak is not a party to any rental agreement and assumes no liability for the condition, safety, or legality of listed equipment or the conduct of any user.
Acceptance
By completing a booking on GoPlayPeak, the Renter and Owner each confirm that they have read, understood, and agree to be bound by this Rental Agreement. This agreement is governed by the laws of the Province of British Columbia, Canada.
